Master Service Agreement & User Policy

Welcome to OMRED. These Terms of Use ("Terms") constitute a legally binding agreement between you ("User") and OMRED ("Company," "we," "us").

By accessing or using the OMRED platform, creating an account, or posting a listing, you agree to be bound by these Terms. If you do not agree, you must immediately discontinue use of the platform.

1. Platform Nature & Role

OMRED acts strictly as an Online Marketplace and Technology Intermediary. You acknowledge that:

  • OMRED is not a real estate broker, lender, seller, buyer or financial advisor.
  • OMRED does not own, sell, or manage the properties listed on the platform by third-party Developers or Sellers.
  • OMRED is not a party to any transaction, negotiation, or contract entered into between Buyers and Sellers or between any of the parties.
  • We do not guarantee the accuracy of project completion dates, RERA statuses, or investment returns.

2. Eligibility & Account Security

2.1 Eligibility

You must be at least 18 years old and capable of forming a binding contract. If you are registering on behalf of a corporate entity (e.g., a Developer or Investment Firm), you represent that you have the authority to bind that entity to these Terms.

2.2 Account Security

Access is secured via Email/Mobile OTP. You are responsible for maintaining the confidentiality of your device and login credentials. You agree to notify OMRED immediately of any unauthorized use of your account.

3. User Obligations & KYC

To maintain a verified ecosystem, you agree to:

  • Provide accurate, current, and complete Know Your Customer (KYC) documentation (Government ID, Company Registration, Tax ID).
  • Not use the platform for money laundering, fraud, or any illegal activity.
  • Not scrape, spider, or use automated bots to harvest data from OMRED.
  • Ensure that any property listing you post is free of encumbrances and that you have the legal right to sell or lease said property.

4. Limitation of Liability & Disclaimer

The Platform is provided "AS IS" and "AS AVAILABLE".

TO THE FULLEST EXTENT PERMITTED BY LAW, OMRED DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED. OMRED SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES RESULTING FROM:

  • The use or inability to use the service.
  • Errors, mistakes, or inaccuracies of content listed by users.
  • Financial loss resulting from real estate investments found through the platform.
  • Any access to our secure servers.

5. Listing Policy & Intellectual Property

5.1 Content Ownership

You retain ownership of the listings and images/videos you upload. However, by posting, you grant OMRED a global, non-exclusive, royalty-free license to display, modify, and promote your content for platform marketing purposes.

5.2 Prohibited Content

We reserve the right to remove any listing without prior notice if it:

  • Violates copyright or trademark laws.
  • Contains misleading financial claims or unverified project statuses.
  • Is reported as fraudulent by other users.

6. Payments & Refunds

Fees paid for Premium Listings, Featured Spots, or Subscription Plans are non-refundable once the service has been activated, regardless of whether the property is sold or the listing is removed.

7. Indemnification

You agree to indemnify and hold OMRED, its affiliates, officers, and employees harmless from any claim, demand, or damage, including legal fees, asserted by any third party due to your use of the Service or violation of these Terms.

8. Governing Law & Jurisdiction

These Terms shall be governed by the laws of India. Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts located in Bhuj/Gandhidham/Ahmedabad, Gujarat.

9. Platform Restrictions (Anti-Piracy & Non-Compete)

The source code, architecture, database structures, user interface design, and algorithms of the OMRED Platform are the exclusive intellectual property of the Company. By using this Service, you expressly agree NOT to:

  • Copy or Clone: Duplicate, copy, modify, create derivative works from, frame, mirror, or republish any portion of the Platform’s proprietary code, design system, or layout.
  • Reverse Engineer: Decompile, disassemble, or attempt to derive the source code, object code, or underlying structure, ideas, or algorithms of the Platform.
  • Build Competitive Products: Access or use the Platform in order to build a product or service that competes with OMRED, or to build a product using similar ideas, features, functions, or graphics.
  • Scraping & Automation: Use any robot, spider, scraper, or other automated means to access the Platform for any purpose without our express written permission.

Strict Liability: Violation of this clause will result in immediate termination of your account, permanent ban from the ecosystem, and legal action for copyright infringement and damages to the fullest extent permitted by law.
